What is VA Disability?

VA disability is a tax-free payment to veterans who have a mental health condition or physical illness that developed:

  • During service
  • After service

If a pre-existing condition was worsened due to service, you may be eligible for benefits. A sliding scale of 10 – 100 percent is used to determine the degree of disability you face. Percentages increase in increments of ten.

Surviving spouses or children of a deceased military member can also seek monetary benefits if the deceased died from a service-connected disability, on active duty or during training. Special Monthly Compensation (SMC) may also be available in certain circumstances, such as losing a limb.

What Happens if My Claim is Denied?

Every year, thousands of VA benefits claims are denied for a variety of reasons, including but not limited to:

  • An incomplete application with missing or wrong information.
  • Your condition is not considered a disability by the VA or is not believed to be related to your service.
  • Your medical evidence does not adhere to the VA’s requirements. To succeed with your claim, you must provide ample medical evidence to the VA, including medical records and other documents that may be difficult to obtain on your own.
  • An important deadline was missed.

A denial can be frustrating and disappointing, but it’s not the end of the road for your claim. You have the right to file an appeal.

The appeals process can be just as complex as the initial application. Having an experienced attorney on your side can make all the difference.

The experienced attorneys at Disability.Law can review your application and file an appeal. If your application is rejected after a review, we can then appeal to the Board of Veterans’ Appeals. The board will review your case and determine whether your case should be approved, sent back for review, or denied.

The board’s decision is typically considered final, so it is crucial to avoid any missteps during the appeals process and ensure you provide all relevant evidence.
